Notarial Services

Alerts
Notary Publics and Commissioners of Oaths and Affidavits in Ontario do not draft or provide legal advice on documents they notarize or commission.

Paralegals, also, are not permitted to draft or give advice on estate or real estate law and most are not licensed to provide services in family law. If seeking such legal assistance, you must consult a lawyer. A notary can notarize wills, powers-of-attorney, and separation agreements but cannot write or give legal advice on them.

ALERT:
The Law Society of Ontario has been made aware of a proliferation of online notary services being offered in Ontario. The Notaries Act does NOT permit notaries to exercise their powers without being in the person’s physical presence, unless regulations so provide. To date, no such regulations have been made by the Ontario government. Beware of those who claim they can notarize documents virtually.
Licensees offering online notary services may be subject to regulatory action by the Law Society. Further, documents notarized in this manner may be invalid and may not be useable for their intended purpose.
Commissioning oaths is pemissible online. However, at this time all commissioning and notarizing, done by paralegal-on-broadview is performed only in person.

When, Where, How Much ?
Everyone is growing increasingly concerned as to whether a document before them is authentic and presented by someone's whose identity has been verified by an appointed professional, in this province by the Ontario Ministry of the Attorney General.
You may have been asked to have a document conmmissioned (swear or affirm that a statement is true before a Commissioner of Oaths and Affidavits) or to have an original or copy of an original document notarized/certified before a Notary Public.

Documents Commonly Notarized
Consent to Travel
Often this consent is not requested, but it may be and it is best to ensure your child's smooth journey across borders with a notarized travel consent. Global Affairs Canada recommends use of their letters below when a minor is travelling alone, with someone other than a parent/legal guardian or with one parent.
